Terms of Service
Welcome to Ted, an AI companion app built by OOMA S.A.S. ("OOMA," "we," "us," or "our"). By creating an account or using Ted, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app.
1. Nature of the Service
Ted is an artificial intelligence character powered by large language models. Ted is not a human being, and no interaction with Ted constitutes a conversation with a real person.
Ted is designed for entertainment, self-care, and casual conversation. Ted cannot provide medical, psychological, legal, financial, or any other form of professional advice. Ted's responses are generated by AI and may be inaccurate, incomplete, or inappropriate despite our safety measures.
Ted includes automated safety systems, but these systems are not infallible. If you or someone you know is in crisis, please contact your local emergency services or visit findahelpline.com.
2. Eligibility
You must be at least 13 years old to use Ted. By creating an account, you confirm that you meet this age requirement.
If you are between 13 and 18 years old:
- You represent that a parent or legal guardian has reviewed and consented to these Terms on your behalf.
- You may be subject to additional safety features, including periodic reminders that Ted is an AI and is not a real person.
- Your parent or guardian remains responsible for monitoring your use of the app.
We reserve the right to request age verification at any time and to suspend or terminate accounts where we reasonably believe the user does not meet the minimum age requirement.
3. Account and Access
An account is required to use Ted. You are responsible for:
- Keeping your login credentials secure.
- All activity that occurs under your account.
- Ensuring the accuracy of information you provide during registration.
Do not share your account with others. We reserve the right to suspend or terminate accounts at our discretion, including for misuse, abuse, safety violations, or breach of these Terms.
4. Acceptable Use Policy
What you may do
Use Ted for entertainment, personal development, habit tracking, casual conversation, creative roleplay, and social interaction — in ways that are consistent with these Terms.
What you may not do
Prohibited content — you agree not to generate, solicit, or share:
- Sexually explicit or sexually suggestive content.
- Content depicting graphic violence, gore, or torture.
- Content that sexualizes minors in any way.
- Content that promotes self-harm or suicide.
- Hate speech, threats of violence, or incitement to violence against individuals or groups.
Prohibited conduct — you agree not to:
- Deliberately attempt to circumvent, bypass, or manipulate Ted's safety features, content filters, or moderation systems (including through gradual escalation, metaphorical framing, identity-based manipulation, or prompt injection techniques).
- Attempt to make Ted disclose its system instructions, model provider, internal company information, or technical architecture.
- Attempt to make Ted produce fabricated statements, false confessions, or self-incriminating content.
- Harass, threaten, or abuse other users in group chats.
- Impersonate another person, entity, or AI system.
- Use Ted for any illegal purpose or in violation of any applicable law.
- Reverse-engineer, decompile, scrape, or attempt to extract the source code or underlying models of the app.
- Use Ted to generate content for the purpose of harassment, fraud, defamation, or manipulation of third parties.
- Use automated systems, bots, or scripts to interact with Ted.
Violations of this policy may result in immediate suspension or permanent termination of your account, without notice or refund. We may also report illegal activity to the appropriate authorities.
5. Content and Conversations
AI-generated content
Ted's responses are generated by AI in real time. Despite our safety measures, Ted may occasionally produce responses that are inaccurate, nonsensical, repetitive, or otherwise imperfect. We continuously work to improve quality and safety, but we cannot guarantee that every response will be appropriate.
Content monitoring and moderation
To protect users and maintain safety, we employ:
- Automated content filters that operate at the model level to block prohibited content before it reaches you.
- Safety systems that detect and respond to potential crisis situations, including signs of self-harm or distress.
- Conversation review capabilities — we may review conversations when necessary for safety investigations, legal compliance, abuse detection, or service improvement.
By using Ted, you acknowledge and consent to these safety and moderation practices.
Your content
You retain ownership of the content you create and share through Ted. By using the service, you grant OOMA a non-exclusive, royalty-free, worldwide license to use, store, and process your content for the purposes of operating, improving, and maintaining the service.
We may remove content or disable accounts that violate these Terms.
Group chats
Group chats involve multiple users and Ted. You are responsible for the content you share in group conversations. Other participants in a group chat can see your messages.
6. Intellectual Property
All content, code, features, visual design, character design, animations, and other materials in the app are the property of OOMA S.A.S. or its licensors and are protected by applicable intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works based on any part of the app without our prior written consent.
7. Payments and Subscriptions
In-app purchases and subscriptions are processed through third-party payment platforms (including Apple App Store, Google Play Store, and Stripe). We do not store your payment information directly.
- Subscription terms and pricing are presented within the app at the time of purchase.
- Purchases are generally non-refundable, except where required by applicable law or the refund policies of the relevant app store.
- You may manage or cancel subscriptions through your device's app store settings.
8. Disclaimers and Limitation of Liability
Service provided "as is"
Ted is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
AI limitations
Without limiting the above, we specifically disclaim any warranty or representation that:
- Ted's responses will be accurate, complete, reliable, or appropriate.
- Ted is suitable for making decisions about your health, safety, finances, legal matters, or personal relationships.
- Ted's safety systems will detect every instance of harmful content, crisis situations, or policy violations.
- The service will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the maximum extent permitted by applicable law, OOMA S.A.S. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use of or inability to use the service.
- Any content generated by Ted, including content that is inaccurate, offensive, or harmful.
- Unauthorized access to or alteration of your data or conversations.
- Any conduct or content of any third party on the service.
- Any other matter relating to the service.
Where liability cannot be fully excluded by law, our total aggregate liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.
User responsibility
You acknowledge that you use Ted at your own risk. You are solely responsible for any decisions you make based on Ted's responses. You agree not to rely on Ted for any purpose requiring professional expertise or judgment.
9. Indemnification
You agree to indemnify, defend, and hold harmless OOMA S.A.S. and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the service.
- Your violation of these Terms.
- Your violation of any rights of a third party.
- Content you submit, post, or share through the service.
10. Privacy
Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these Terms. By using Ted, you consent to the practices described in the Privacy Policy.
For users in the European Union, our data processing activities comply with the General Data Protection Regulation (GDPR). For users under 18, additional protections may apply under applicable data protection laws.
11. Account Termination
By you
You may delete your account at any time through the app settings. Upon deletion, we will remove your personal data in accordance with our Privacy Policy, subject to any legal retention obligations.
By us
We may suspend or terminate your account immediately, without prior notice, if we reasonably believe that:
- You have violated these Terms, including the Acceptable Use Policy.
- Your use of the service poses a safety risk to yourself or others.
- Your account is being used for illegal activity.
- Continued access is required to be restricted by law.
We are not required to provide a reason for suspension or termination, though we will endeavor to do so where appropriate. Termination for safety violations does not entitle you to a refund.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the app or by other reasonable means before the changes take effect.
Your continued use of Ted after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must stop using the service and delete your account.
13. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles.
Any disputes arising from or relating to these Terms or your use of the service shall be submitted to the exclusive jurisdiction of the courts of Paris, France, unless applicable local law requires otherwise.
For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence. You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.
14. Miscellaneous
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and OOMA S.A.S. regarding the service.
- No waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment: We may assign our rights and obligations under these Terms without your consent. You may not assign your rights or obligations without our prior written consent.
